Debtor in Possession Representation

WCV has represented debtors-in-possession during every phase of the reorganization process.  WCV has experience in handling all phases of Chapter 11 case administration including:  filing of the bankruptcy petition and schedules and statement of affairs, preparing and filing first day motions, seeking retention of professionals and applications for compensation, negotiating for or seeking court authorization to use cash collateral, negotiating for and seeking court authorization for obtaining credit (debtor in possession financing), representation at meeting of creditors, analyzing and filing motions for assumption and rejection of executory contracts and leases, filing motions for the sale of property under Section 363 of the Bankruptcy Code, preparing disclosure statement, solicitation of votes, preparing and filing plan of reorganization, seeking confirmation of plan of reorganization, and post confirmation matters.

Unsecured Creditor Committee Representation 

WCV has represented unsecured creditor committees during every phase of the reorganization process including negotiating and litigating with debtors-in-possession and secured creditors to maximize recovery for unsecured creditors.  As counsel for unsecured creditor committees, WCV has investigated claims against secured creditors and other unsecured creditors, analyzed avoidance actions and claim objections, and participated in plan confirmation proceedings.

WCV has also represented a variety of creditors (secured, unsecured, trade vendor) in various business reorganization cases.  WCV has defended creditors in claim objection matters, and defended claims raised in adversary proceedings.

Seller-Purchaser Representation and "Distressed" Asset and Equity Investments

WCV has represented both sellers and purchasers in Section 363 sales of all or substantially all of the assets of various debtors.  WCV has experience in “distressed” asset and equity acquisitions and claims trading procedures.
